together. all of us care about health care. we don't believe that obama care is the way to afford that kind of care to the people. and in fact, the congressional budget office, again, said that our approach, the one that's patient based, the one that allows for more flexibility four health savings accounts, the one that says that people request purchase health care across state lines and a plan that had in it safeguard for those with pre-existing conditions but did not implement a plan that raised prices the way that obama care does. the president knows we have that plan. so it is a little bit baffling to hear the president say what he says, and i'm hopeful that he'll stop and he'll actually begin to listen to the kinds of things that many of us have been talking about and that we've had discussions about with others in his white house but frankly, he's not listening. >> we also want to get your thoughts on this, on what the obama administration is calling an enrollment surge. they are pleased that 29,000 people signed up for obama care in the first 48 hours since their november 30 relaunch

a couple of days ago. tens of thousands of americans who think they have health insurance under obama care may discover january 1 that they do not. after days of refusing to release the stats on the problems that have been plaguing health care.gov the administration has announced under pressure from the press that the enrollments of 1 of every 4 people in the months of october and november were botched. at least one of every four. now since then they say at least one of every ten federal applications have had problems, since the fix. they think the number is higher in the state exchanges. a reporter pressed the agency in charge of the exchanges, the federal exchange for a solution to the mess. people think they have the coverage. they don't have the coverage. the insurer has a botched form. it doesn't have a name so it can't call the person to tell them, it didn't work for you. here was the answer. >> but you're not saying everyone should call. you're not suggesting urging them strongly despite the fact you are talking about a potential one in ten error rate going forward? >> i would encou

put forward, if they're saying we need to end obama care, they're going to be taking away health insurance from people who have had it for a while. and that itself can be a powerful counterattack. but interestingly enough, it's not just democratic government who's embracing this, it's a handful of republican governors as well. and i think that that is a really revealing sort of point. governor kasich of ohio said the reason we're doing the medicaid expansion is it's a human issue, it's a moral issue that these people need to be covered. and i feel like those voices are going to begin to get more attention as well. >> so, susan, suzy is not wrong on this point, one of the things that republicans are right about when they have angst about the government, that once it is implemented, it is hard to go take it away. so this point that once people have the obama care, talking about repealing it or taking it back becomes a very different issue than having never implemented it. does that mean it's sort of the end of that repeal discussion going forward? >> well, the repeal portion, yes.

a clean bill of health for obama care. deputy senior adviser from the white house joins me from the north lawn. david, thank you very much. you set a fairly low bar, this vague working for majority that want to sign on and 50,000 could be served at one time, 800,000 in a day. is that good enough? what's the next step? >> so andrea, as you know, this is going to be a process of continuous improvement. compared to where we were in early october as jeff said yesterday it is night and day to the point we can handle a certain number of concurrent users. we're monitoring to make sure the system is stable, the response times are good, the error rates are continuously going down. we've set up a queueing system for those instances where there's overwhelming volume on the system to better manage the flow. we've set up anonymous shopping right on the home page of healthcare.gov so people can look at plans in a much more comprehensive way. based on what we learn, we continue to make these improvements. so by the time we get to the end of open enrollment march 31st, as many people who want to sign up

is there are provisions in obama care that only take effect if the states establish these health insurance exchanges, only if there is an exchange, quote, established by the state. now those provisions include the subsidies available through exchanges and the employer mandate, the penalties imposed on employers if they don't offer what the government considers adequate health insurance. 34 states said they're not going to create exchanges and the federal government is operating exchanges in those states so that means those provisions by law are inoperative in those states. employers in those 34 states are exempt from those taxes. >> right. >> but what the the obama administration is doing, is the exact opposite of what the law says. the exact opposite. they are issuing the subsidies and imposing those taxes in those 34 states and their rationale for doing the opposite of what the law says is that's what congress intended. >> but wait a second. we have a congress, we can fact check this with the people who pass the law. they're still there. they're sitting in their seats in that domed building. where are t
